In criminal cases

Article 46, paragraph 2, of the Constitution of the Russian Federation establishes that everyone who is detained, remanded in custody or accused of committing a crime has the right to have the assistance of a lawyer (defense counsel) from the moment of arrest, remand in custody or indictment. Under article 182, paragraph 11, of the Code of Criminal Procedure, the person whose premises are being searched or adult members of his or her family shall be present during the search. During the search may be present defense counsel, as well as the lawyer of the person whose premises are searched. Thus, you have the right to have a defense counsel present during the search of your home. In order to exercise your right, you should contact your lawyer before the search.

Article 96, paragraph 1, of the Code of Criminal Procedure of the Russian Federation establishes that, as soon as possible but not later than 3 hours from the time of his or her delivery to the body of inquiry or to the investigator, a suspect is entitled to one telephone conversation in Russian in the presence of the person conducting the inquiry or the investigator in order to notify close relatives, relatives or close persons of his or her detention and location, a notation of which is made in the record of detention. In order to exercise your right, it is necessary to address a police officer in writing.

In civil cases

In such cases, the Consumer Rights Protection Law establishes a penalty for violation of the term for delivery of prepaid goods, a penalty for refusal to voluntarily satisfy the consumer's claim and a fine in the amount of 50% of the price of the goods and the accrued penalty.

In addition to paying compensation for a low-quality product or service, the seller may be obliged by the court to pay a penalty, compensate for moral or material damage and pay an additional fine of 50% of the amount for refusing to voluntarily fulfill the consumer's requirements.
